Master the E1 and E2 Visa Process: Essential Steps for Immigrants

Introduction

The process of obtaining an E1 or E2 visa to allow immigrants and entrepreneurs to set up businesses in the United States can be confusing and complex. Many applicants struggle to find out the eligibility criteria for the special visas and the complex procedures that have to be completed to apply for them.

In order to ensure that your application for an E1 or E2 visa is approved and you can start to enjoy the business opportunities that the United States has to offer, there are a number of key steps that have to be completed.

This article attempts to clarify the process for E1 and E2 visas and provides some practical advice to help deal with the most difficult aspects of the process to assist in achieving your dreams in America.

Clarify E1 and E2 Visa Fundamentals

The process to obtain an E1 visa and an E2 visa can be very complex and often misunderstood. First, the classification of E1 is for treaty traders who are engaged in very substantial ongoing trade in goods and services, including information technology products between the United States and the trader’s home country. The trade must be very substantial and ongoing in order to warrant E1 classification in seeking an E1 visa.

The E1 and E2 visa is also for treaty investors. In order to qualify for an E2 visa, an individual would have to invest a substantial amount of money in a U.S. corporation and have to maintain control of the company.

Recently, interest in these special trade and investor permits to engage in business in the U.S. has increased sharply, as approvals for both the E1 and E2 visas are being granted weekly for even the most complex of applications. Approval statistics for both trade and investor permits are rising sharply from lows experienced during the worst of the COVID-19 pandemic, as outlined in the graphs below.

Lately, all E-2 visa applications are subject to substantial documentation of business activity. Proof of operational existence, such as signed contracts, a lease, and evidence of activity in business checking accounts is critical to approval of an E-2 application. Recently, a treaty country’s consulting firm obtained E-2 classification as an employee of the firm. It had a substantial investment in the U.S. business and clearly outlined plans to generate significant revenue in the future.

Note: From October 1, 2025, all new E-visa applications, as well as E-visa renewals, and also all dependent family members will have to appear for an interview at a U.S. embassy or consulate in their respective countries. We suggest you prepare required documents for the business applicant as well as to describe business operations in detail to get approved in the interview.

Outline Application Requirements for E1 and E2 Visas

Information on the E1 and E2 visa requirements to qualify for these types of work permits are set out below. The E1 visa requirements and the E2 requirements for approval to apply for an E1 or E2 visa are somewhat similar but there are some key differences for approval of the E1 or E2 visa application.

E1 Visa Requirements:

  1. Nationality: You must be a national of one of the countries with which the United States has signed a treaty.
  2. Trade: There must be substantial trade between the U.S. and the foreign nation of the principal alien (not just between the U.S. subsidiary and the alien’s country). This trade can be in goods and/or services.
  3. Business Ownership: You must either be the owner of the trading company or hold a key position within the company.
  4. Documentation: As part of the ongoing application process, trade records, invoices, etc. can be required to prove that the applicant's business is still trading and that the applicant is still employed by the trading company.

E2 Visa Requirements:

  1. Nationality: You need to be a national of a treaty country.
  2. Investment: You must invest substantial capital in the U.S. business. Typically the amount of capital required is around $80,000 to $300,000. The amount must have been invested and be at risk in the E2 Enterprise(s).
  3. Control: Your E2 visa application will be approved if you have 50% or more ownership of an enterprise(s) or you have authority to control and manage an enterprise(s) in the United States.
  4. Non-Marginal Enterprise: The applicant must demonstrate that the proposed Enterprise(s) will have the capacity of generating more than sufficient income to support you and your immediate family at wage-level U.S. earnings while you are present in the United States.
  5. Documentation: Detailed business plan for your proposed for-profit enterprise and documentation regarding the investment amount (as well as proof of where the applicant obtained the funds).

The same requirements for approval of an application for an E-1/E-2 visa permit, as outlined above, apply to the E-2 application. Completion of online Form DS-160 and the applicable application fee is required for all E-2 applications. However, a new $250 Visa Integrity Fee is required to be paid by applicants applying for approval of an E-2 visa permit on or after October 1, 2025. Developing a strong and credible business plan for the applicant’s proposed for-profit enterprise is critical to approval of an E-1/E-2 visa application. Furthermore, all funds invested by the applicant must be at risk and fully committed to the applicant’s proposed enterprise for approval of an E-2 application. The E-2 denial rate for fiscal year 2023 was 9.3%. All applications are evaluated on a case-by-case basis and applicants whose E-1/E-2 visa application has been denied have various options, including an appeal and an alternate application, such as an L-1 New Office Permit application or an EB-5 Immigrant Investor Program application.

Guide Through the E1 and E2 Visa Application Process

The E1 and E2 visa can present many opportunities for growth, but obtaining the visa can be very complex. In order to get approved for an E1 or E2 visa all of the requirements must be met. The following is a step by step guide to the E1 and E2 visa process.

Step 1: Determine Eligibility

  • Confirm that you and your business are eligible to apply for either an E1 or E2 visa as a national of a treaty country.

Step 2: Gather Required Documentation

  • Proof of nationality: This can be a valid/unexpired passport. If the applicant is married, a copy of the front and back of the spouse’s passport is also required.
  • All the documents listed above under Evidence Required must be organized in a clear and organized manner and all must be copied on the left side of the paper.

Step 3: Complete the DS-160 Form

  • The online application for a non-immigrant visa (Form DS-160) must be completed accurately and in full.

Step 4: Pay the Visa Application Fee

  • Payment of required application fee for E1 and E2 visas which differs based on several criteria including the type of visa for which the application is made as well as the nationality of the applicant. The MRV fee for FY2026 is USD 315.

Step 5: Schedule Your Visa Interview

  • After you completed the DS-160 application for your E1 and E2 visa online, you can schedule your visa interview at the embassy or consulate of the country where you reside. Wait times for E1 and E2 visa interviews vary widely depending on the location of the applicant, with South Korea, Turkey and Latin America (Brazil, Mexico, etc.) having the longest average wait times of several weeks to several months.

Step 6: Prepare for Your Interview

  • Be ready to give a full and fair explanation of how you intend to develop and run your international business from within the United States and explain how you will earn sufficient money to support yourself and all other family members intending to travel to the US on your visa too. While the minimum financial contribution required to secure approval of an application for an E1 and E2 visa is as low as $100,000 (all cash) the applicant’s ability to present full and adequate supporting evidence in respect of all requirements outlined in E1/E2 Visa Requirements (Left Hand Menu) will determine approval. 6,108 E-2 applications were rejected by U.S. consulates in the FY2024 period for failure on the part of applicants to present applications with full and adequate supporting evidence in respect of requirements outlined.

Step 7: Attend the Visa Interview

  • Arrive on time for your scheduled interview time. In FY2024, the approval rate for E-1 and E-2 visa applications to enter the U.S. to develop and manage an international business was 90.1%. These applications were approved because the applicant adequately prepared for the interview and presented the required documentation to obtain approval of their application for entry into the U.S.

Remember that with proper preparation and documentation, an E1 or E2 visa can become a doorway to furthering your future goals and accomplishments.

Address Challenges in the E1 and E2 Visa Applications

If your E1 and/or E2 visa application is denied because of lacking or missing documentation, all your efforts will have been in vain. It is already difficult enough to complete the application process for these two special visas to the U.S. In order to help you, we have listed the most common problems with application for the E1 and E2 visa.

Common Challenges:

  1. Lacking Required Documentation: Your dreams of moving to the U.S. with your family while operating your own business can be shattered due to one minor oversight in document preparation. In 2026, for example, incomplete application packages were identified as the cause of avoidable delays for E1 and E2 visa applications through U.S. Embassies and Consulates in hundreds of cases. Avoid these kinds of avoidable problems with your E1 and/or E2 visa application by making sure complete and accurate documentation is presented in your application package.
  2. Substantial Trade or Capital: For the E-2 permit, applicants must demonstrate that the trade and/or capital that will be taken to the U.S. to develop a business is substantial. Although there is no minimum capital requirement for an E-2 visa under U.S. immigration regulations for the E-2 permit, the typical amount of money required for startup of most businesses is $100,000 or more. Such applications need to contain detailed records of the investor’s out-of-pocket money and a realistic and solid business plan that outlines anticipated startup capital for the applicant’s future business in the U.S. such as to develop trade.
  3. All Treaty Countries have their own specific requirements: For the E-2 visa, an applicant must be a national of one of the countries which are parties to a qualifying treaty of commerce and navigation with the U.S. Typical requirements such as minimum investment amounts and/or other special requirements of individual countries need to be met for approval.
  4. Interview Preparation: The most important thing to be prepared for the interview, i.e. to provide good documentation, a good business plan, and to clearly explain your role in the business. Common interview questions with explanations of the investor’s strategies as well as the funding of the business to rehearse.

Solutions:

  • Work with an Immigration Attorney: In order to help ensure your successful application for an E1 and/or E2 visa, do not waste your money applying for these special visas. Seek the services of an experienced U.S. immigration attorney early on in the process and get sound, specific advice on how to best proceed to reach your goals.
  • Review Your Materials Thoroughly: In order to avoid wasting your time and money to apply for an E1 and/or E2 visa, a thorough review of all of your completed forms and supporting documents prior to their submission is recommended in order to identify any errors or omissions that may cause delays or even cause your application to be denied.
  • Prepare for the Interview: Find out the typical questions asked for E1, E2 and E3 visa applications and prepare answers to these questions and outline your financial plans for your proposed business as well as outline your proposed role of your business. These will be the main part of your documentation and you must be able to present your case to the immigration officer confidently and effectively.
