Introduction
For many healthcare workers around the world, the H-1A process can seem like an endless, complex procedure. However, hope and support exist for those workers trying to navigate through the process. This article details the processes and requirements to receive an H-1A visa and tries to aid soon-to-be-nurses in obtaining the appropriate visa in this chaotic time.
Define the H-1A Visa Program
Immigration to the U.S. to work as a health care worker can be very complex. Health care workers have been classified as immigrants and temporary workers since 1989, when the classification was created to allow foreign graduate nurses to enter the country on a temporary basis. Although the H-1C program for nurses ended in 1995, many foreign nurses are currently trying to get work authorization to bring their skills to work in the U.S. health care system.
There are many work authorization programs for health care workers. As noted by author Jeanne Batalova in this article, the health care sector is changing and many of these programs are needed to fill the many workforce gaps that are developing in the health care sector.

Outline Eligibility Requirements for H-1A Visa Applicants
The H-1A Requirements for visa application to allow International Nurses to come to the US to work as soon as possible. I thought that the requirements for an H-1A would be listed on the U.S. Department of Labor website but they are not. So after lots of research I compiled the requirements for the H-1A application for nurses to work in the US. This would be very helpful for the International Nurses trying to get to the US to work as soon as possible.
- Job Offer: You must have a job offer from an employer in the U.S. who will be sponsoring you for the H-1A visa in order to work as a Registered Nurse in the U.S.
- Licensure: You must hold a current nursing license for the state in which you intend to work.
- Education: Proof of completion of the required amount of education for the position for which you will be working as a nurse (typically a degree in nursing or equivalent to such).
- Proof of Need: The employer must demonstrate that there are not enough qualified U.S. workers to fill the position for which the foreign worker is offered employment.
- Temporary Nature: The employment must be temporary or seasonal.
The rules for foreign nurses who would like to fill gaps for such needed work here are intended to allow their employment by qualified employers during times of extreme need. The H-1A visa program, established to enable such employment, however, expired in 1995 and to date no qualified nurses have been able to secure H-1A visas to come here and work to fill our pressing needs for their services. With a projected shortage of 800,000 nurses by 2020, it would be of extreme importance to learn the rules for their employment here so that we can receive the care so desperately needed from such skilled professionals.

Explain the H-1A Visa Application Process
Don’t Let the h-1a Visa Process Get You Down - Just Read Through the Process Step by Step.
- Employer Petition: The American employer must file a petition for the applicant’s h-1a visa, e.g. by describing his needs for foreign nurses for the positions offered by this employer.
- Labor Condition Application (LCA): The initial petition for foreign labor is filed with USCIS by the employer on behalf of the applicant. Approval by the Department of Labor of the employer’s Labor Condition Application (LCA) is required by USCIS before the petition can be filed with USCIS. The LCA includes assurances of minimum wages and working conditions of American workers with comparable experience that will be employed by the same employer at the same place of employment.
- Documentation: A number of documents must be submitted to apply for an h-1a visa. These would include a copy of all of the applicant’s education certificates and licenses as well as proof of the job offer from the prospective employer. All of the required documents have to be complete and accurate in order to avoid any denial of application for lack of documentation.
- USCIS Approval: The employer must file the petition with the U.S. Citizenship and Immigration Services (USCIS), the national immigration authority, and receive approval of the petition in order to start hiring foreign nurses for work in the U.S. through the h-1a visa.
- Requesting for a Visa: After approval by USCIS of the petition filed by an employer, the foreign nurses and their employers jointly apply for a visa at a U.S. Embassy or Consulate in their country of residence. Each applicant is required to go to the interview with a Consular Officer and to bring the required documents for processing of their applications for visas to work in the U.S.
As the process is well-structured and the cost of $100,000 or so for certain recruits known to both employers and candidates in advance, it facilitates both parties’ planning and financial preparations and issues the permit to foreign nurses, wishing to work in the U.S., in a most efficient way.

Identify Limitations and Challenges of the H-1A Visa
The H-1A visa process for trying to get foreign health care workers into the U.S. health care system can be very stressful for health care workers, such as nurses, trying to get work in the U.S. health care system.
- H-1A Status is typically granted for up to three years and can be extended in certain circumstances. The vast majority of foreign educated nurses entering the U.S. health care system are seeking to work in the U.S. health care system on a long-term basis. Thus, temporary status could be a big problem for these nurses.
- Job Dependency: Once you have obtained an H-1A visa you are a temporary employee of the sponsoring U.S. company. Therefore, if you change jobs within the U.S. you will have to apply for another visa within a short time frame, typically within 10 days of the new employment date.
- Regulatory Changes: The current and past regulations of immigration to U.S. health care systems are changing frequently. A change for worse in the policies of the Trump administration to be effective as of January 1, 2026 is expected to negatively affect foreign workers in general including nurses seeking to work in the U.S. health care systems.
- Nurses take jobs from “Americans”: Applicants may encounter increased scrutiny from immigration authorities when U.S. employers apply for authorization to employ foreign workers, including nurses, because of the mistaken belief that hiring foreign nurses will take jobs from “Americans”.
- H-1A Visa Program Termination: Similar reasons for the termination of the H-1A visa program for foreign medical graduates to enter the U.S. medical field in 1995 could apply today under our current American laws and be the reason for denial of future applications of FMGs hoping to enter the U.S. health care system.
With this information, you will be able to make informed decisions about your health care career.
