  1. How long were you together in your marriage?: Since I know that you and your husband were married for 15 years, this will be your starting point in your efforts to determine how long you can expect to pay maintenance.
  2. Maintenance based on the length of your marriage:
  • Less than 5 years: 20% of marriage length.
  • 5 to 10 years: Support for the dependent spouse will typically last for 30% of the union length. An example would be if you are married for 7 years then the dependent spouse would receive 2.1 years of support.
  • 10 to 15 years: Support may be required for as long as 40% of the marriage length.
  • 15 to 20 years: Maintenance may last for 50% of the union length. This is to give the independent spouse a fair opportunity to become economically self-sufficient after such a long term of marriage during which they have shared financial resources and a common household.
  • Over 20 years: There is typically a conclusion to support of alimony payments while the receiving spouse is alive. This would typically be until the passing of the paying spouse. Some are granted for life but this is determined by the court at the alimony final hearing.
  1. TERMINATION OF SUPPORT: Information for less than 5 years of marriage above applies. For 5 to 10 years of marriage an example of support length is 2.1 years of support. For 10 to 15 years of marriage an example of support length is 4 years of support or 40% of 10 years of marriage or 5 years of marriage * .4 or 2.1 years. In general for 15 to 20 years of marriage support will continue for 50% of 15 to 20 years of marriage or 7.5 to 10 years of support or for the rest of the life of the paying spouse. In North Carolina until the paying spouse’s death and/or dependent spouse’s death as with child support.
  2. An example of the information above being used in calculation for duration of support: A couple who were married for 10 years could expect to pay and receive support for 4 years. A couple who were married for 25 years could expect to pay support indefinitely or for a long time.
